B. Take all appropriate action to amend the American Rescue Plan Act budget to allocate $27,000 from the Brazos River Erosion Project to the Beasley Water/Sewer Project for project management.

Take all appropriate action to create an exploratory committee in conjunction with Human Resources and to submit an Application to the Texas Department of Health and Human Services for the designation of Fort Bend County office(s) as a mother friendly worksite.

26. ENGINEERING:

A. Take all appropriate action on authorization to purchase Parcel R260258_01 in the amount of $24,997.66 plus the necessary costs, authorize the County Judge to sign all closing documents regarding West Sycamore Segment 2, Mobility Bond Project No. 17122x, Precinct 2, and authorize County Clerk to record said deed and related documents in the Official Public Records at no cost. B. Take all appropriate action on Advance Funding Agreement between Fort Bend County and Texas Department of Transportation in an initial amount not to exceed $5,272,939, in which the County will be responsible for fifty percent of the actual construction cost overruns incurred by Texas Department of Transportation regarding Grand Parkway (SH 99) Frontage Road – Segment 2, Mobility Bond Project No. 17304, Precinct 1. (Fund: Certificates of Obligation)

C. Take all appropriate action on Agreement to Accept Donation of Real Property between Fort Bend County and The Texas Department of Transportation regarding the donation of Parcel 237 of FM 723, Precincts 1 and 4.

D. Take all appropriate action on conveyance of Special Warranty Deed between Fort Bend County and Texas Transportation Commission, regarding Parcel 237 of FM 723, Precincts 1 and 4, and authorize County Clerk to record in the Official Public Records at no cost.

E. Take all appropriate action on Amendment to Development Agreement between Fort Bend County and 10 Harlem AC, LLC to obligate the County to reimburse one hundred percent of the actual costs of improvements made to Harlem Road, Mobility Bond Project No. 17402, Precincts 3 and 4. F. Take all appropriate action on acceptance of a 4.39 acre tract of land conveyed by Donation Deed from Dry Creek Houston ASLI VII, LLC to Fort Bend County regarding A. Meyers Road right of way dedication, Precinct 2 and authorize County Clerk to record said deed in Official Public Records at no cost.

G. Take all appropriate action on authorization to purchase Parcel R112775 in the amount of $176,314.66 plus the necessary costs, authorize the County Judge to sign all closing documents regarding 10th Street, Mobility Bond Project No. 20106, Precinct 4, and authorize County Clerk to record said deed and related documents in the Official Public Records at no cost. (Fund: Mobility Bonds)

H. Take all appropriate action on request for variance to the landscaping reserves requirements as stated in Section 7.3.A.1, of the Fort Bend County Regulations of Subdivisions for Jordan Ranch Section 40 on behalf of IDS Engineering. Inc., Precinct 1.

I. Take all appropriate action on the plat for the roads within Jordan Ranch Section 40, Precinct 1.

J. Take all appropriate action on the plat for the lots within Jordan Ranch Section 40, Precinct 1.

27. FACILITIES MANAGEMENT & PLANNING:

Take all appropriate action to approve the use of Certificates of Obligation to replace the faulty lighting control system at the Fort Bend County Jail in an amount not to exceed $204,000.

28. FIRE MARSHAL:

Take appropriate action on request to transfer funds in the amount of $125,232 from accounts detailed on the Director's form dated September 1, 2022 to cover overtime compensation accumulated during the fiscal year 2022.

29. HUMAN RESOURCES:

Take all appropriate action on revisions to the Employee Information Manual, specifically Section 709, Sick Leave, as submitted by Human Resources.

31. MEDICAL EXAMINER:

Take all appropriate action on request to transfer the amount of $116,911 from Salaries and Non-Departmental Contingency into Accounts detailed on Director's form dated August 30, 2022 to allocate funds to cover negative balance and part-time doctors and investigator fees through FY2022.

32. PARKS & RECREATION:

A. Take all appropriate action to grant a variance to the prohibition on the use of private security for a Fairgrounds rental as requested by CenterPoint Energy for an event to be held at the Fort Bend County Fairgrounds beginning Friday, October 14, 2022 through Sunday, October 16, 2022; with supervision of the private security to be provided as agreed to by the Office of Fort Bend County Constable Four with all costs to be paid by CenterPoint Energy at no costs to the county.

B. Take all appropriate action on request to waive minimum hourly requirement of (2) hours for use of rental space at Landmark Community Center for the dates of August 3, August 10, August 17, August 24, and August 31, 2022 due to a clerical error made during reservation.

C. Take all appropriate action on request to waive remaining rental fee balance of $22 for use of Landmark Community Center on August 13, 2022; due to a clerical error.

33. PUBLIC TRANSPORTATION:

A. Take all appropriate action on execution of the award from the Federal Transit Administration for FAIN No. TX-2022-037-00 for Fiscal year 2021 Section 5307 Coronavirus Response and Relief Supplemental Appropriations Act of 2021 (CRRSAA) funds in the amount of $5,636,635 with no local County match required.(Fund: Public Transportation Grants)

B. Take all appropriate action on Amendment No. 3 to Project Grant Agreement No. DIS 2102 (12) 129_20 between Fort Bend County and Texas Department of Transportation to revise the budget and extend the Grant Agreement end date to May 31, 2023 with no change in local match.

34. PURCHASING:

A. Take all appropriate action on Agreement for Replacement of Check Printing Software between Fort Bend County and MHC Software Holdings, Inc. pursuant to RFP 22-091 in a total contract amount not to exceed $146,802 for a period of three (3) years. (Fund: Treasurer Fees)

B. Take all appropriate action on Amendment to Agreement between Fort Bend County and Cobb, Fendley and Associates, Inc. for Broadband Network Feasibility Study Phase 2 including Engineering, Consulting, Design and Technical Assistance to apply for the Middle Mile Grant in an amount not to exceed $40,580 and a total contract amount not to exceed $140,178.40. (Fund: American Rescue Plan Act)

C. Take all appropriate action on First Amendment to Agreement for renewal with price increase of Janitorial Services at Fort Bend County Buildings and Facilities between Fort Bend County and McLemore Building Maintenance, Inc. utilizing The Interlocal Purchasing System Contract No. 200106, in an amount not to exceed $995,714.76 for FY2023. (Fund: Facilities Management & Planning and Library)

D. Take all appropriate action on Agreement between Fort Bend County and Schneider Electric Buildings Americas, Inc., utilizing ESC Contract No. R220703, for software and hardware upgrades for the Libraries in an amount not to exceed $72,800. (Fund: Information Technology and Library)

E. Take all appropriate action on Agreement between Fort Bend County and National Signs, LLC, utilizing Choice Partners Contract No. 22/023/MJ-01, for the purchase of a monument sign and display board at Jones Creek Ranch Park, in an amount not to exceed $149,832. (Fund: Parks Bond)

F. Take all appropriate action on Addendum to Agreement between Fort Bend County and Star Service, Inc., utilizing TIPS Contract Nos. 2201060.1 and 2201060.2, for the replacement of two (2) HVAC units at the Fort Bend Boys & Girls Club in an amount not to exceed $67,041. (Fund: Facilities)

G. Take all appropriate action on Agreement between Fort Bend County and Tetra Tech, Inc., pursuant to RFP 19-04, to provide Hazard Mitigation Plan Consulting Services for Emergency Response in the amount not to exceed $123,343 effective September 1, 2022 through June 30, 2023. (Fund: Homeland Security & Emergency Management)

H. Take all appropriate action on Addendum between Fort Bend County and Swagit Productions, LLC utilizing TIPS Contract No. 190703 for the purchase of equipment and services for the Commissioner’s Courtroom upgrade, in the amount not to exceed $69,415. (Fund: American Rescue Plan Act)

I. Take all appropriate action on Bid 22-094, Reconstruction of Wash Bay at Road and Bridge Beechnut Facility.

J. Take all appropriate action on Bid 22-095 Generator Replacement for Road and Bridge Beechnut.

K. Take all appropriate action on Bid 22-098, term contract for Contingency Mosquito Vector Control Services.

L. Take all appropriate action on Bid 22-099, term contract for Purchase of Tires and Tubes.

M. Take all appropriate action on Amendment to Agreement between Fort Bend County and Geotech Engineering and Testing to increase the contract in the amount of $87,653 for a total contract amount not to exceed $198,334, pursuant to SOQ 14-025; regarding Katy Flewellen, Mobility Bond Project No. 13316, Precinct 1. N. Take all appropriate action on Agreement for Construction Materials Testing Services between Fort Bend County and Terracon Consultants, Inc. in a total contract amount not to exceed $169,825, pursuant to SOQ 14-025; regarding Bamore Road, Segment 2, Mobility Bond Project No. 17105, Precinct 4. (Fund: Mobility Bonds)

O. Take all appropriate action on Amendment to Agreement between Fort Bend County and Binkley & Barfield, Inc. to increase the contract in the amount of $499,094.90 for a total contract amount not to exceed $5,951,344.90, and extend the contract time through December 31, 2026, pursuant to SOQ 14-025; regarding FM 521 South, Mobility Bond Project No. 17111, Precinct 2. (Fund: Mobility Bonds)

P. Take all appropriate action on Seventh Amendment to Project Management Agreement between Fort Bend County and Schaumburg & Polk, Inc. to increase the contract in the amount of $73,147 for a total contract amount not to exceed $1,311,919, and extend the contract time through December 31, 2023, pursuant to SOQ 14-025; regarding 2013 Mobility Projects in Precincts 1, 2, 3 and 4. (Fund: Mobility Bonds)

Q. Take all appropriate action on Change Order No. 1 between Fort Bend County and Main Lane Industries, Ltd, to increase the contract in the amount of $85,905.43 for a total contract amount not to exceed $781,722.93, pursuant to Bid No. 21-101; regarding Cinco Ranch Turn Lanes at SH 99, Mobility Bond Project No. 17314x, Precinct 1. (Fund: Fort Bend County Assistance District No. 1)

R. Take all appropriate action on Second Amendment to Agreement between Fort Bend County and R.G. Miller Engineers, Inc. to increase the contract in the amount of $153,979 for a total contract amount not to exceed $1,581,892.88, and extend the contract time through December 31, 2025, pursuant to SOQ 14-025; regarding Beechnut Street, Mobility Bond Project No. 17410, Precincts 3 and 4. (Fund: Mobility Bonds)

35. ROAD & BRIDGE:

A. Vehicle Maintenance: Take all appropriate action on request to transfer the amount of $830,000 as detailed on the Auditor's form dated August 24, 2022 from Non-Departmental Purchase Order Contingency and Information Technology into Vehicle Maintenance Fuel to allocate funds for fuel through September 30, 2022.

B. Vehicle Maintenance: Take all appropriate action on request to transfer the amount of $37,000 from Non-Departmental Contingency to Vehicle Maintenance Supplies and Maintenance to allocate funds for tires and parts through September 30, 2022.

36. SHERIFF'S OFFICE:

Take all appropriate action on Modification Number 1 to Award No. G22HN0010A by the Executive Office of the President to decrease the amount of the High Intensity Drug Trafficking Area Program award by $812,183 resulting in a revised total award in the amount of $972,618 with no cash match required by Fort Bend County for the period ending December 31, 2023.

37. TAX ASSESSOR/COLLECTOR:

A. Take all appropriate action on Interlocal Cooperation Agreements for the Collection of Taxes between Fort Bend County and the following entities effective through September 30, 2022: 1. City of Sugar Land; 2. Park at Eldridge, a Public Improvement District; and 3. Enclave at River Park, a Public Improvement District.

B. Take all appropriate action on Amendments to Interlocal Cooperation Agreements between Fort Bend County and the following entities for change in the services to be provided and increase in the total maximum compensation under the Agreements effective through September 30, 2022. 1. Cinco Municipal Utility District No. 5; and 2. Cinco Municipal Utility District No. 2.

38. Approve Bills.

39. Ratify the release of time-sensitive disbursements by County Auditor on September 1, 2022.

40. Meet in Closed Session to deliberate the following matters as authorized by the Texas Government Code:

A. § 551.071. Consultation With Attorney. Commissioners Court will meet in Closed Session to seek the advice of its attorney about pending or contemplated litigation; a settlement offer; or on a matter in which the duty of the attorney to Commissioners Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551.

B. § 551.074. Personnel Matters. Commissioners Court will meet in Closed Session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; or to hear a complaint or charge against an officer or employee.
