30. COMMISSIONER, PCT. 1:

Take all appropriate action on Interlocal Agreement for Joint Participation to Relocate the Jaybird Monument between Fort Bend County and the City of Richmond. (Fund: Landfill Tipping Fees)

A. Take all appropriate action on Interlocal Agreement between Fort Bend County and City of Fulshear for the design and construction of the proposed Wallis Street project.

B. Take all appropriate action to request to US Army Corps of Engineers for an extension to the public comment period for Buffalo Bayou and Tributaries Resiliency Study Interim Feasibility Report from its current termination date to December 31, 2020, to allow for a full 90 days of review by those impacted by this study and to request the release of all models and data used to complete the study.

A. Take all appropriate action on Application to the Texas Indigent Defense Commission for the FY 2021 Formula Grant; authorize electronic submission of the application, and adopt Resolution in support of the Application.

B. Take all appropriate action on request to transfer the amount of $9,140 from FY 2020 Non-Departmental Contingency into Auditor - Contract Vehicles to replenish contract vehicle capital mileage account for the premature retirement of Vehicle Unit T118 due to extensive repairs needed.

C. Take all appropriate action on request to use 2020 Certificate of Obligation to fund purchase of crawler for Drainage District once solicitation selection is made.

D. Discuss and consider taking all appropriate action on Revision No. 5 to amend the Fort Bend County CARES Act Local Government Assistance budget by transferring $7,000,000 from the Hospitals and Clinics account and $500,000 from the Health Care Services account into the following accounts: Rental and Mortgage Assistance: $4,000,000 for a newly created “Phase 4” for the month of December 2020; Missouri City Projects: $2,000,000 for the MCTX CARES Act Small Business Assistance Program and the Rental, Mortgage & Utility Assistance Program currently underway; Small Business Assistance: $370,000 for an addendum to the agreement with Carter Brothers Consulting for additional services for the Small & Minority Business COVID-19 Recovery program; Utilities Assistance: $630,000; and Fort Bend County COVID-19 Projects: $500,000.

33. COMMUNITY SUPERVISION & CORRECTIONS DEPARTMENT:

Take all appropriate action on request to transfer the amount of $45,211 from FY 2021 Non-Departmental Contingency into Community Supervision & Corrections Department, Fees, to allocate funds for shortfall due to increased electronic monitoring fee waivers by the courts.

34. CONSTABLE, PCT. 1

A. Take all appropriate action on request to add one Police Package Tahoe vehicle as addition to fleet for the Office of Constable Pct. 1 in accordance with the Agreement for Additional Law Enforcement with Fort Bend County Municipal Utility District No. 155, which increased the staffing by one deputy.

B. Take all appropriate action on request to replace Vehicle Unit T118 assigned to the Agreement for Additional Law Enforcement Services with Fort Bend County Municipal Utility District No. 162, as recommended by the Fleet Manager.

35. CONSTABLE, PCT. 2:

Take all appropriate action on request to transfer the amount of $12,378 from FY 2021 Non-Departmental Contingency into accounts as detailed on Constable's form dated October 23, 2020 to allocate funds for payment of overtime anticipated in FY 2021.

36. COUNTY ATTORNEY:

A. Take all appropriate action on request for Payment of an Actual Cost Self-Move Submission in the amount of $138,564.76 regarding Parcel 5 of the OEM Expansion Project, Precinct 1. (Fund: 2020 Certificates of Obligation)

B. Take all appropriate action on two requests for Direct Payment of Commercial Bid Estimates for Negotiated Self-Move in the amount of $200 each regarding Parcel 6 of the OEM Expansion Project, Precinct 1. (Fund: 2020 Certificates of Obligation)

37. DISTRICT ATTORNEY:

Take all appropriate action on the Independent Contractor Agreement and Release pertaining to the No Refusal Grant Program; authorize the Fort Bend County District Attorney’s Office to execute the Independent Contractor Agreement and Release with blood technicians or phlebotomists as needed for an hourly amount not to exceed $50 and a maximum expenditure of $9,200 effective through September 30, 2021. (Fund: District Attorney No Refusal Program Grant)

38. ENGINEERING:

A. Take all appropriate action on request for temporary road closure, pursuant to Section 251.011 of the Texas Transportation Code, for Hunt Road Phase I and Hunt Road Phase II, just west of FM359, to be closed during construction of roadway repairs; closure to begin November 30, 2020 until construction is complete, Precinct 3.

B. Take all appropriate action on request for temporary road closure beginning October 30, 2020 until November 2, 2020, pursuant to Section 251.011 of the Texas Transportation Code, for Cane Island Parkway between FM 1463 and Kingsland Boulevard, Mobility Bond Project No. 17308, Precinct 3.

C. Take all appropriate action on Resolution and Order to Abandon and Vacate regarding a portion of Skinner Road right of way measuring 0.0016 of an acre for Brandt Road, Mobility Bond Project No. 17310, Precinct 3.

D. Take all appropriate action on acceptance of a 2.794-acre tract of land and a 0.584-acre tract of land conveyed by donation deed from Parkway Lakes Master LTD to Fort Bend County and authorize payment of title policy fees related to such conveyance, regarding parcels 3A and Parcel 3B of Beechnut Street, Mobility Bond Project No. 17410, Precinct 4; authorize County Clerk to record in the Official Public Records at no cost. E. Take all appropriate action on Second Interlocal Project Agreement between Fort Bend County and Sienna Plantation Municipal Utility District No. 5 regarding the District's contribution to FM 521, Mobility Bond Project No. 17111, Precinct 1.

F. Take all appropriate action on Encroachment Agreement between Fort Bend County and Monument Pipeline LP regarding Lake Olympia Segment 1, Mobility Bond Project No. 13207, Precinct 2.

G. Take all appropriate action on Amendment to Standard Utility Agreement between Fort Bend County and CenterPoint Energy to increase the amount of the contract by $25,716.44 for a total contract amount not to exceed $82,854.82 for utility relocations regarding FM 762/FM 2759 (Crabb River Road), Mobility Bond Project No. x28, Precinct 1. H. Take all appropriate action on payment of Invoice No. 3000954431 in the amount of $82,854.82 to CenterPoint Energy Houston Electric, LLC for utility relocations regarding FM 762/FM 2759 (Crabb River Road), Mobility Bond Project No. x28, Precinct 1. (Fund: Right of Way)

I. Take all appropriate action on Encroachment Agreement between Fort Bend County and Kinder Morgan Tejas Pipeline LLC regarding Beechnut, Mobility Bond Project No. 17204, Precincts 2 and 3.

J. Take all appropriate action on Reimbursement Agreement between Fort Bend County and Kinder Morgan Tejas Pipeline LLC in an amount not to exceed $59,466 regarding Beechnut, Mobility Bond Project No. 17204, Precincts 2 and 3.

39. FACILITIES MANAGEMENT & PLANNING:

A. Take all appropriate action on request to transfer the amount of $8,700 from Non-Departmental Contingency, as detailed on Director's form dated October 9, 2020, to allocate funds to add outdoor benches to the courthouse complex.

B. Take all appropriate action on Agreement between Johnson Controls, Inc. and Fort Bend County to provide Facility Improvement Services and authorize the County Judge to sign the agreement pending County Attorney approval.

40. HEALTH & HUMAN SERVICES:

A. Emergency Medical Service: Take all appropriate action on request to modify the Fiscal Year 2021 Fleet Management for Emergency Medical Service and authorize four (4) replacement Tahoe vehicles instead of three (3) replacement Suburban vehicles with no change to the budget.

B. Emergency Medical Service: Take all appropriate action on request for EMS to retain Vehicle Unit U083 until damaged Unit Y121 is repaired or replaced.

41. HOMELAND SECURITY & EMERGENCY MANAGEMENT:

A. Take all appropriate action on request to purchase one property, File Number: BOFB1800481, under the 2016 Hazard Mitigation buyout grant (FEMA Project Number DR-4269-006 and FEMA Project Number DR-4269-007) in the amount of $204,727.19 plus the necessary closing costs, with an overall project cost match by the County of twenty-five percent, and authorize County Judge to sign all closing documents. (Fund: 2016 Hazard Mitigation Grant)

B. Take all appropriate action on Resolution authorizing submission of grant application to the Texas General Land Office for Community Development Block Grant - Mitigation funds in the amount of $96,907,994.36 for the Brazos River Erosion Control project, with a one percent cash match by the Drainage District and Fort Bend County General Fund.

C. Take all appropriate action on Resolution to the State of Texas, Office of the Governor, authorizing the submission of grant applications for Homeland Security Grant program projects for the term of September 1, 2020 through August 31, 2022.

42. INFORMATION TECHNOLOGY:

A. Take all appropriate action on request for exception to Vehicle Policy Section 612.07 to allow vehicles that are assigned to the Information Technology Department, as presented by Director, to be used as Take Home Vehicles temporarily, including two vehicles outside of Fort Bend County, from October 27, 2020 through November 4, 2020, in order to provide support to Elections.

B. Take all appropriate action on request to transfer the amount of $38,250 from FY 2021 Non-Departmental Contingency into Information Technology, Fees to allocate additional funds for supplemental contract workers for the November elections.

43. PARKS & RECREATION:

Take all appropriate action on request to reclassify vacant Position Number 6601-0025 from Clerk II, Grade 6 of the Administrative Clerical Policy Group to Parks Recreation Assistant, Grade 9 of the Administrative Clerical Policy Group, in the Parks & Recreation Department, effective October 27, 2020. (Fund: Parks Department)

44. PUBLIC TRANSPORTATION:

A. Take all appropriate action on request to waive the fare for Fort Bend County Public Transportation Demand Response services on November 3, 2020, to encourage residents to go vote on Election Day. (Fund: Public Transportation, Grants)

B. Take all appropriate action on Master Research Agreement between Fort Bend County and Texas A&M Transportation Institute to perform research projects for a total amount not to exceed $500,000 over the five-year contract term. (Fund: Public Transportation, Grants)

C. Take all appropriate action on Project Grant Agreement #RPT 2102 (11) 045_20 between Fort Bend County and Texas Department of Transportation for Fiscal Year 2020 Section 5311 Rural Federal funds in the amount of $415,044, to be matched with RUR 2102 (11) Fiscal Year 2021 5311 State funding award and no local match required. (Fund: Public Transportation Grants)

D. Take all appropriate action on Project Grant Agreement No. RUR 2102 (11) between Fort Bend County and Texas Department of Transportation for Fiscal Year 2021 Section 5311 State Funds in the amount of $325,738 with no local match required. (Fund: Public Transportation Grants)

E. Take all appropriate action on the intent to propose new commuter services to downtown Houston to the Houston Galveston Area Council Commute Solutions Program for Congestion Mitigation and Air Quality funds in the amount of $2,000,000 with a local match amount up to $500,000 to be requested as Transportation Development Credits (TDCs); if TDCs are not approved, up to fifty percent of local cash match will be provided by project partner, the Downtown District. (Fund: Public Transportation, Grants)

45. PURCHASING:

A. Take all appropriate action on Amendment No. 2 to Agreement for Subscription and Renewal between Fort Bend County and iCIMS, Inc. for Recruit Application Access services in an amount not to exceed $124,212.16 effective October 1, 2020 through September 30, 2023. (Fund: Information Technology)

B. Take all appropriate action on Sixth Amendment to Agreement between Fort Bend County and Family Health Center Inc., dba Access Health for COVID-19 testing services to increase the amount by $3,500,000 for a total contract amount not to exceed $5,500,000 effective until December 30, 2020. (Fund: COVID-19)

C. Take all appropriate action on First Amendment to Agreement for Laboratory Services between Fort Bend County and Baylor Miraca Genetics Laboratories, LLC, for COVID-19 Testing services and Specimens to increase the scope of services by $400,000 for a total contract amount not to exceed $500,000 effective through December 30, 2020. (Fund: COVID-19/FEMA-PA)

D. Take all appropriate action on request to purchase four (4) message signs from Dobie Supply, Inc. utilizing BuyBoard Contract No. 608-20 for an amount not to exceed $69,000. (Fund: CARES Act)

E. Take all appropriate action on Amendment between Fort Bend County and A-Rocket Moving & Storage, Inc. for moving services to include the location of Smart Financial Center for the delivery and pick-up of voting equipment, utilizing Buy Board 559-18, for an additional amount of $5,200 and a total contract amount not to exceed $112,495. (Fund: Elections Help America Vote Act)

F. Take all appropriate action on request to purchase four (4) dump trucks for Road and Bridge from Performance Truck, utilizing Buy Board Contract 601-19 for a total amount not to exceed $549,455.12. (Fund: 2020 Certificates of Obligation)

G. Take all appropriate action on Bid 21-018 for the purchase of vehicles.

H. Take all appropriate action on request to authorize the purchase of vehicles pursuant to Bid 21-018 as indicated on Purchasing Agent’s form and authorized in the FY 2021 budget process.

I. Take all appropriate action on Bid 21-015 Demolition Services for Disaster Relief and Recovery Programs DR 4269-006 and DR 4269-007.

J. Take all appropriate action on Seventh Amendment for renewal of Professional Services Agreement between Fort Bend County and MVM, Inc. for intelligence analysts in an amount not to exceed $415,000 effective October 1, 2020 through September 30, 2021. K. Take all appropriate action on Bid 21-016 for Reconstruction of Bryan Road from City of Rosenberg City Limit to FM 2977; Mobility Bond Project No. 17118.

L. Take all appropriate action on request to amend Bid 18-014, term contract for Pest Control Services with Gillen Pest Control, to add quarterly pest control for Mission Bend Community Center and the Landmark Community Center for an additional amount not to exceed $580 annually. (Fund: Parks)

M. Take all appropriate action on Bid 21-013 for Septic System at Daily Park.

P. 46. RISK MANAGEMENT:

Take all appropriate action on the Fort Bend County Employee Benefit Medical Plan Document, to be effective August 11, 2020.

47. SHERIFF'S OFFICE:

Take all appropriate action on Modification Number 2 to Award No. G20HN0010A for the County to receive additional funds in the amount of $41,250 from the Executive Office of the President for the High Intensity Drug Trafficking Area program, for a total award of $1,692,896 with no cash match from Fort Bend County for use through December 31, 2021.

49. Ratify the release of time-sensitive disbursements by Auditor on October 22, 2020.

50. WORKSHOP:

Workshop to receive presentation by Fort Bend County Childcare Task Force regarding funding of Childcare Assistance Programs under the CARES Act and take action if necessary.

51. Meet in Closed Session to deliberate the following matters as authorized by the Texas Government Code:

A. § 551.071. Consultation With Attorney. Commissioners Court will meet in Closed Session to seek the advice of its attorney about pending or contemplated litigation; a settlement offer; or on a matter in which the duty of the attorney to Commissioners Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551.
