23. BEHAVIORAL HEALTH SERVICES:

Take all appropriate action on request to reclassify one part time position into a full time position, Special Projects Coordinator, Grade 12 of the Professional Management Policy Group, in the Behavioral Health Services Department, effective February 11, 2020. (Fund: Bureau of Justice Assistance Grant)

24. COMMUNITY DEVELOPMENT:

A. Take all appropriate action on the Section 108 Loan Guarantee Application to the U.S. Department of Housing and Urban Development in the amount of $3,384,000 for the City of Arcola water plant.

B. Take all appropriate action on the Subrecipient Agreement between Fort Bend County and City of Orchard in the amount of $253,031.81 for water system improvements, part of the FY 2019 Consolidated Annual Action Plan approved by Commissioner’s Court on July 2, 2019. (Fund: Community Development Block Grant)

25. COMMUNITY SUPERVISION & CORRECTIONS DEPARTMENT:

Take all appropriate action on Grant Application and Resolution to the Office of the Governor, Criminal Justice Division, for grant funding in the amount of $130,000 for the Felony Drug Court (CARD) and the Misdemeanor Drug Court programs, with no matching funds required by Fort Bend County for the period of September 1, 2020 through August 31, 2021.

26. DISTRICT ATTORNEY:

Take all appropriate action on request to issue a check in the amount of $10,000 to Fort Bend County Crime Victim's Response Team for distribution to local non-profit organizations to assist victims of violent crime. (Fund: District Attorney, Special Account)

27. ENGINEERING:

A. Take all appropriate action on Amendment to Fort Bend County Regulations of Subdivisions, specifically Appendix K regarding Independent Testing Lab Certifications, Precincts 1, 2, 3 and 4.

B. Take all appropriate action on Development Agreement between Fort Bend County and Chad Wleczyk in an amount not to exceed $76,800 regarding Bamore Road, Segment 2, Mobility Bond Project No. 17105, Precinct 1. (Fund: 2017 Mobility Bonds)

C. Take all appropriate action on request to purchase Parcel 6 in the amount of $4,328 plus the necessary costs and authorize County Judge to sign all closing documents regarding said parcel for Old Needville-Fairchilds Road, Mobility Bond Project No. 17108, Precinct 1. (Fund: 2017 Mobility Bonds)

D. Take all appropriate action on request to purchase Parcel 7 in the amount of $16,205 and Parcel 8 in the amount of $5,879.50 plus the necessary costs and authorize County Judge to sign all closing documents regarding said parcels for McCrary Road, Mobility Bond Project No. 17313x, Precinct 3. (Fund: 2017 Mobility Bonds)

E. Take all appropriate action on request to purchase Parcel 7 in the amount of $31,358.95 and Parcel 8 in the amount of $29,477.95 plus the necessary costs, and authorize County Judge to sign all closing documents regarding the said parcels for Beechnut Street, Mobility Bond Project No. 17410, Precincts 3 and 4. (Fund: 2017 Mobility Bonds)

F. Take all appropriate action on request for variance to the sidewalk requirement as stated in Section 5.8 of the Fort Bend County Regulations of Subdivisions for Lakes of Bella Terra West, Section 4 from Benchmark Engineering Corporation, Precinct 3.

G. Take all appropriate action on request for variance to the major thoroughfare median opening requirements as stated in Section 5.2.C.5, of the Fort Bend County Regulations of Subdivisions along Katy Gaston Road adjacent to Katy Gaston Tract plat, from BGE, Inc. on behalf of Trendmaker Homes, Inc., Precinct 3.

H. Take all appropriate action on request for variance to the block length requirements as stated in Section 5.5.A.2, the building setback requirement as stated in Section 5.12.C.1 and the lot size requirement as stated in Section 5.14.E.4 of the Fort Bend County Regulations of Subdivisions for Katy Gaston Tract on behalf of Trendmaker Homes, and Shops at Katy Gaston LLC, Precinct 3.

I. Take all appropriate action on plat for the roads within Katy Gaston Tract, Precinct 3.

J. Take all appropriate action on plat for the lots within Katy Gaston Tract, Precinct 3.

28. FIRE MARSHAL:

A. Take all appropriate action on request for one new full time position, Fire Plans Examiner, Grade 12 of the Professional Management Policy Group, and two part time Fire Inspector positions, in the Fire Marshal's Office, effective February 11, 2020.

B. Take all appropriate action on request to transfer the amount of $139,993 as detailed on Marshal's form dated February 5, 2020 to amend the budget pursuant to Local Government Code Section 111.07075 and allocate into salary line items for additional personnel.

29. INFORMATION TECHNOLOGY:

A. Take all appropriate action on request to deposit all costs and fees received as payment of a Public Information request into the Information Technology Residual Account established by Commissioners Court on February 4, 2020, pursuant to Texas Administrative Code, Chapter 70, Rule Section 70.3.

B. Take all appropriate action on request to collect Public Service Fees the for services provided by the Information Technology Department to the public such as training development, programming, presentations, videography, web development, travel, etc., as presented in the Fee Schedule for Public Services, and deposit said fees into the Information Technology Residual Account established by Commissioners Court on February 4, 2020.

30. PARKS DEPARTMENT:

Take all appropriate action on Agreement for Operation and Programming between Fort Bend County and the Boys and Girls Clubs of Greater Houston, Inc. in the amount of $300,000 to provide outreach services at the Mission Bend Community Center effective March 1, 2020. (Fund: Parks Department and Fort Bend County Assistance District No. 6)

31. PUBLIC TRANSPORTATION:

Take all appropriate action on Application to Texas Department of Transportation for Fiscal Year 2019 Section 5339 Discretionary Federal funds in the amount of $653,931 for rolling stock and equipment with $130,786 in transportation development credits, including grantor’s request for submittal of additional information.

32. PURCHASING:

A. Take all appropriate action on request to purchase two (2) Fusion vehicles, additions to fleet for the Fire Marshal from Helfman Ford, for an amount totaling $33,100 pursuant to Bid 15-028. (Fund: General Fund, Advance Funding Resolution)

B. Take all appropriate action on Bid 20-040, term contract for pavement painting and marking services and supplies for various roads.

C. Take all appropriate action on Bid 20-042, term contract for purchase and installation of carpet.

D. Take all appropriate action on Bid 20-043, term contract for thermoplastic traffic coating.

E. Take all appropriate action on Bid 20-052 for the Construction of Cane Island Parkway Phase 2, from FM 1463 to IH 10, Fort Bend County Mobility Bond Project No. 17308.

F. Take all appropriate action on Bid 20-054, purchase of herbicide spray truck for Road & Bridge.

G. Take all appropriate action to consider granting an exemption to the competitive bid process as authorized by Local Government Code Section §262.024 (a)(7) for the purchase of an item available from only one source, for West Publishing Corporation services from Thomson Reuters for Law Library, in the amount not to exceed $521,889.04, effective through fiscal year of 2030. (Fund: Law Library)

H. Take all appropriate action on Subrecipient Agreement between Fort Bend County and City of Rosenberg in the amount of $519,169 for water system improvements, part of the FY 2019 Consolidated Annual Action Plan approved by Commissioners Court on July 2, 2019. (Fund: Community Development Block Grant)

I. Take all appropriate action on Second Amendment to Agreement between Fort Bend County and DISA Global Solutions for Employee Alcohol and Drug Testing Services pursuant to term contract, RFP 19-001, to increase the cost of each Commercial Driver’s License holder’s DOT drug test by $2.50 to cover additional costs of the new mandated reporting responsibilities to the Federal Motor Carrier Safety Administration Clearinghouse effective January 6, 2020 through September 30, 2020. (Fund: Human Resources and Risk Management)

J. Take all appropriate action on Addendum to Business Continuity Agreement between Fort Bend County and Tyler Technologies, Inc. for disaster recovery annual maintenance in an amount not to exceed $76,500 effective August 1, 2019 through July, 31, 2020. (Fund: Information Technology)

K. Take all appropriate action on Agreement for Construction Inspection Services between Fort Bend County and Sowells Construction Management & Inspection, LLC in an amount not to exceed $513,456 regarding construction inspection services for Mobility Bond Projects with Precincts 1, 2, 3, and 4. (Fund: 2017 Mobility Bonds)

L. Take all appropriate action on Agreement for Professional Traffic Design Services between Fort Bend County and Gunda Corporation in an amount not to exceed $34,116 pursuant to SOQ 14-025, regarding Gaston Road at Northlight Lane, Project No. TS19304, Precinct 3. (Fund: Fort Bend County Assistance District No. 10)

M. Take all appropriate action on Agreement for Professional Traffic Design Services between Fort Bend County and Gunda Corporation, in an amount not to exceed $50,707 pursuant to SOQ 14-025, regarding Falcon Landing Boulevard at Evening Canyon Lane, Project No. TS19305, Precinct 3. (Fund: Fort Bend County Assistance District No. 1)

33. Approve Bills.

34. Authorize Auditor to pay and release time-sensitive disbursements on February 13, 2020, to be ratified by Commissioners Court on February 25, 2020.

35. Meet in Closed Session to deliberate the following matters as authorized by the Texas Government Code:

A. § 551.071. Consultation With Attorney. Commissioners Court will meet in Closed Session to seek the advice of its attorney about pending or contemplated litigation; a settlement offer; or on a matter in which the duty of the attorney to Commissioners Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551.

B. § 551.074. Personnel Matters. Commissioners Court will meet in Closed Session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; or to hear a complaint or charge against an officer or employee.
