Take all appropriate action on request for temporary road closure for road improvements, pursuant to Section 251.011 of the Texas Transportation Code, for Old Needville-Fairchilds Road between FM 361 and SH 36 to be closed during construction beginning October 23, 2019 until construction is complete, Mobility Bond Project No. 17109, Precinct 1.

B. Take all appropriate action on Development Agreement between Fort Bend County and Robert Cortez, Jr., to accept an Owner's contribution of land and funds regarding Koeblen Road, Precinct 1.

C. Take all appropriate action on request for payment of Change Orders to the Agreement between Fort Bend County and Texas Department of Transportation as follows: No. 33 in the amount of $29,748.71; No. 34 in the amount of $13,553.71; and No. 35 in the amount of $5,364.46 regarding the widening of Trammel Fresno Road pursuant to the Advance Funding Agreement approved by Commissioners Court on August 12, 2008, Mobility Bond Project No. 746, Precincts 1 and 2. D. Take all appropriate action on request to purchase Parcel 2 in the amount of $16,220 plus the necessary costs, and authorize the County Judge to sign all closing documents regarding Old Needville-Fairchilds Road, Mobility Bond Project No. 17108, Precinct 1. (Fund: 2017 Mobility Bonds)

E. Take all appropriate action on request to purchase Parcel 5 in the amount of $30,363 plus necessary costs, and authorize County Judge to sign all closing documents regarding Benton Road, Segment 1, Mobility Bond Project No. 17110, Precinct 1. (Fund: 2017 Mobility Bonds)

F. 35. FIRE MARSHAL:

Take all appropriate action on request to waive Fire Code Permit Fees for Fort Bend County Emergency Services District No. 4 regarding construction of a new facility at 33301 FM 1093 in Simonton, Precinct 3.

36. HEALTH & HUMAN SERVICES:

A. Take all appropriate action on request to transfer the amount of $72,778 from 2019 Non-Departmental Contingency into Health & Human Services, Fees to allocate funds for payment of autopsy related services through September 30, 2019.

B. Social Services: Take all appropriate action on Application to the Texas Veterans Commission for the 2020-2021 General Assistance Grant, requesting $250,000 in grant funds to continue providing financial assistance for Veterans and their families in Fort Bend County, with no cash match required by Fort Bend County.

37. LIBRARY:

A. Take all appropriate action on request to establish a rental fee for the third floor of the Missouri City Branch Library, and set up a residual fund with the fees received to be used for library programming, exhibits, author visits, and other such approved events for the facility.

B. Take all appropriate action on Program Agreement between Fort Bend County and Caring Critters, Inc. for a pilot program administered by the Library.

38. PARKS & RECREATION:

Take all appropriate action on request to add Projector Fees for Lodge to the Rental Fee Schedule at Jones Creek Ranch Park, as presented by Parks Director,

A. Take all appropriate action on Amendment to Select Government Merchant Payment Instrument Processing Agreement between Fort Bend County and Chase Paymentech, LLC for additional banking services.

B. Take all appropriate action on RFQ 19-092 for Design/Build Pavilion at Daily Park for Fort Bend County.

C. Take all appropriate action on Bid 19-087 for the purchase of Helicopter Night Vision Equipment for Fort Bend County.

D. Take all appropriate action on request to purchase two (2) Link Belt excavators for the Drainage District from Nueces Power Equipment for an amount not to exceed $601,150 utilizing Houston-Galveston Area Council Contract EM06-17. (Fund: General Fund, Advance Funding Agreement)

E. Take all appropriate action on request to purchase one (1) John Deere dozer for the Drainage District from Doggett, utilizing Buy Board Contract Number 515-16 for an amount not to exceed $150,188.23. (Fund: General Fund, Advance Funding Resolution)

F. Take all appropriate action on request to purchase one (1) Bell Articulated Dump Truck for the Drainage District from Bell Trucks America Inc. for an amount not to exceed $309,000 utilizing Houston-Galveston Area Council Contract Number EM06-19. (Fund: General Fund, Advance Funding Resolution)

G. Take all appropriate action on Third Amendment to Agreement between Fort Bend County and Frost Construction Company, Inc., to decrease the contract amount by $3,794.98 for a total contract amount not to exceed $1,692,524.24, pursuant to RFP 17-025 for Construction of Pinnacle Aquatic Fitness Center. H. Take all appropriate action on Sixth Amendment for renewal of Professional Services Agreement for Intelligence Analysts between Fort Bend County and Meador Staffing Services, Inc. in an amount not to exceed $846,000 effective October 1, 2019 through September 30, 2020. (Fund: Sheriff's Office, High Intensity Drug Trafficking Area Grant)

I. Take all appropriate action to authorize the continued purchase of hospital services related to sexual assaults, from Harris County Hospital District, to grant an exemption to the competitive bidding pursuant to Local Government Code Section 262.024(a)(4) and Code of Criminal Procedure Article 56.06(c), effective through September 30, 2020. (Fund: Sheriff's Office)

J. Take all appropriate action on request to purchase security monitoring services from SHI Government Solutions, in an amount not to exceed $56,503.50 utilizing Buy Board Contract 579-19 effective August 17, 2019 through November 15, 2022. (Fund: Information Technology)

K. Take all appropriate action on First Amendment to Agreement for Professional Construction Management Services between Fort Bend County and Huitt-Zollars, Inc., pursuant to RFQ 19-020, to replace Exhibit A, Scope of Services for Westpark Park and Ride, with no change in compensation.

L. Take all appropriate action on First Amendment to Work Authorization No. 7 between Fort Bend County and WSP USA, Inc., pursuant to RFP 15-072 in the amount of $7,211.11, for a total work authorization amount not to exceed $144,194.11, and to extend the time of performance through March 31, 2020 regarding the transit feasibility study. (Fund: Public Transportation Grant)

M. Take all appropriate action to consider granting an exemption to the competitive bid process, as authorized by Local Government Code §262.024(a)(7) for the purchase of an item available from only one source, for print materials for the Library System from The Penworthy Company, in the amount not to exceed $80,000 for FY 2020. (Fund: Library)

N. Take all appropriate action on Amendment to Agreement for Professional Engineering Services between Fort Bend County and Paradigm Consultants, Inc. to increase the scope of services by $96,110 for a total contract amount not to exceed $271,116 pursuant to SOQ 14-025, regarding construction materials testing services for Gaston Road, Segment 1, Mobility Bond Project No. 13311, Precinct 3. (Fund: 2013 Mobility Bonds)

O. Take all appropriate action on Agreement for Professional Environmental Services between Fort Bend County and Berg-Oliver Associates, Inc. in an amount not to exceed $30,800 pursuant to SOQ 14-025 regarding Old Richmond Road and Belknap Road, Mobility Bond Project Nos. 17208 and 17211, Precincts 2 and 3. (Fund: 2017 Mobility Bonds)

40. SHERIFF'S OFFICE:

A. Take all appropriate action on Organized Crime Drug Enforcement Task Force Agreement, to accept additional grant funds for the strike force/strategic initiative programs administered by the Sheriff's Office, with no additional funds required by Fort Bend County for the period of October 1, 2019 through September 30, 2020: $150,816 for professional language analyst services; $14,837.50 for flash drives and programming services; $18,649 for overtime; and $15,447.04 for rental vehicle and incidental expenditures.

B. Take all appropriate action on Victim Assistance and Counseling Agreement between Fort Bend County and Fort Bend County Women's Center to provide victim assistance and counseling services essential for compliance with the Prison Rape Elimination Act (PREA).

42. Ratify the release of time-sensitive disbursements by Auditor on October 17, 2019.

43. Authorize County Auditor to pay and release time-sensitive disbursements on October 31, 2019, to be ratified by Commissioners Court on November 5, 2019.

44. Meet in Closed Session to deliberate the following matters as authorized by the Texas Government Code:

A. § 551.071. Consultation With Attorney. Commissioners Court will meet in Closed Session to seek the advice of its attorney about pending or contemplated litigation; a settlement offer; or on a matter in which the duty of the attorney to Commissioners Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551.

B. § 551.072. Deliberation Regarding Real Property. Commissioners Court will meet in Closed Session to deliberate the purchase, exchange, lease or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person.

C. § 551.074. Personnel Matters. Commissioners Court will meet in Closed Session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; or to hear a complaint or charge against an officer or employee.
