Take all appropriate action on letter from The George Foundation regarding the Fort Bend County Aquatic Fitness Center, reference number 2014-0155, to extend the timeframe for use of grant funds until June 30, 2017, with no change in funding or other grant terms.

23. COMMISSIONER, PCT. 3:

A. Take all appropriate action on Amendment to Reimbursement Agreement, whereby Fort Bend County, Brazoria County, and Port Freeport will each advance additional funds in the amount of $50,000 to support the Brazoria-Fort Bend Rail District's 2017 budget. (Fund: Non-Departmental Contingency)

B. Take all appropriate action on request to transfer the amount of $50,000 from Non-Departmental Contingency, as detailed on Commissioner's form dated January 26, 2017 to allocate funds for the reimbursement agreement regarding the Brazoria-Ft-Bend Rail District.

24. CONSTABLE, PCT. 1

Take all appropriate action on request to transfer the amount of $6,300 from Non-Departmental Contingency into Constable, Precinct 1, Operating Supplies for the purchase of body armor/vests for deputies.

25. CONSTABLE, PCT. 3:

A. Take all appropriate action to direct the County Auditor on disposition of County Assets not located during exit interview of the Office of Constable, Precinct 3, as presented on inventory report dated February 7, 2017.

B. Take all appropriate action on request to transfer the amount of $5,700 from Non-Departmental Contingency into Constable, Precinct 3, Capital Acquisitions, to allocate the difference in cost to purchase one Tahoe in lieu of one Truck that was budgeted for FY 2017.

26. COUNTY ATTORNEY:

A. Take all appropriate action on Resolution and Order Decreeing the Acquisition of Property to be a Public Necessity and Authorizing the Acquisition and Payment of Compensation by Record Vote for the extension of Williams Way, Mobility Bond Project No. 13114, Pct. 1.

B. Take all appropriate action Resolution and Order Decreeing the Acquisition of Property to be a Public Necessity and Authorizing the Acquisition and Payment of Compensation by Record Vote for West Airport Boulevard, Mobility Bond Project No. 13411, Pct. 4.

27. DISTRICT ATTORNEY:

Take all appropriate action on Grant Application and Resolution to the Office of the Governor, Criminal Justice Division, for grant funding in the amount of $126,625 for the Violence Against Women Prosecutor and Investigator program, with a cash match by Fort Bend County of $128,711 for a total program budget of $255,336 for the period of September 1, 2017 through August 31, 2018, and authorize County Judge to sign all documents pertaining to the Application. (Fund: District Attorney)

28. ENGINEERING:

A. Take all appropriate action on request for temporary road closure of Katy Gaston Road at Enchanted Crossing during construction, pursuant to Section 251.011 of the Texas Transportation Code. The closure date begins February 14, 2017, and is expected to end on March 8, 2017 regarding Mobility Bond Project No. 733a, Precinct 3.

B. Take all appropriate action on acceptance of a certain 0.3313 acre tract of land for right of way dedication conveyed by Donation Deed from The Most Reverend Daniel Cardinal Dinardo to Fort Bend County, Texas regarding FM 1093/Westpark Extension and; record same in Official Public Records; Precinct 3.

C. Take all appropriate action on Agreement between Fort Bend County and Teal Run General Maintenance Association, Inc. for the installation, operation and maintenance of Dynamic Speed Feedback Signs within Teal Run Subdivision, Precinct 1.

D. Take all appropriate action on Interlocal Agreement between Fort Bend County and Fort Bend County Municipal Utility District No. 185 for the installation and maintenance of solar powered speed awareness signs, Precinct 3.

E. Take all appropriate action on Interlocal Agreement between Fort Bend County and Fort Bend County Water Control & Improvement District No. 2 in the amount of $458,280 regarding the District's participation in Ludwig Road, Mobility Bond Project No. 13208, Precinct 2.

29. FACILITIES MANAGEMENT & PLANNING:

Take all appropriate action on request to transfer the amount of $7,000 from Non-Departmental Contingency into the Legion Court Annex project account to allocate funds for monitor and ClickShare set up in the courtroom.

30. FIRE MARSHAL:

Take all appropriate action on request to transfer the amount of $16,200 from Non-Departmental Contingency as detailed on Fire Marshal's form dated January 30, 2017 to allocate funds to purchase replacement foam necessary for equipment maintained by the Hazmat team.

31. HEALTH & HUMAN SERVICES:

A. Social Services: Take all appropriate action on First Amendment to Agreement with United Way of Greater Houston, to extend the time frame for expenditure of Disaster Recovery funds regarding the impact of 2016 floods until June 30, 2017, with no change in funding.

B. Social Services: Take all appropriate action on request to approve payment in the amount of $142.40 to Fiesta Mart No. 6 for food purchase made by client on December 12, 2016 that exceeded the standard amount of food voucher, due to clerical error. (Fund: Social Services, Public Assistance)

32. HUMAN RESOURCES:

Take all appropriate action on request to reclassify vacant Position Number 6501-0011, in the County Library, from Library Clerk II, Grade 6 of the Administrative Clerical Policy Group, to Library Clerk III, Grade 7 of the Administrative Clerical Policy Group, effective February 7, 2017.

33. JUVENILE PROBATION & DETENTION:

A. Take all appropriate action on Intergovernmental Agreement between Houston-Galveston Area Council and Fort Bend County for the County to receive grant funds in the amount of $14,000 in support of mental health assessment and/or therapy for referred juveniles for the term ending August 31, 2017, to be ratified by the Juvenile Board at their next meeting.

B. Take all appropriate action on USDA Foods Agreement between Fort Bend County and Texas Department of Agriculture regarding the distribution of federal food programs for the Juvenile Probation facility.

34. PURCHASING:

A. Take all appropriate action on request to transfer the amount of $179 from Non-Departmental Contingency into Purchasing, Capital Acquisitions, to allocate remaining funds for the purchase of a larger conference table.

B. Take all appropriate action on SOQ 17-042 for professional construction management services.

C. Take all appropriate action on request to transfer three Tahoe vehicles from the Vehicle Maintenance reserve pool as replacements to fleet for the Office of Constable, Precinct 3.

D. Take all appropriate action on request to purchase vehicles for various departments, pursuant to Bid 17-021.

E. Take all appropriate action on request to purchase additional Microsoft volume licensing for an amount not to exceed $152,720 from SHI Government utilizing Texas Department of Information Resources Contract DIR-SDD-2503, for the remainder of fiscal year 2017, and an additional amount not to exceed $183,264.00 for the final contract year of 2018. (Fund: Information Technology)

F. Take all appropriate action on request to ratify the purchase and installation of heat roof units at George Family Development Center, as authorized by Section 262.024 (a)(3) Texas Local Government Code for unforeseen damage to public property, from Howell Services, in an amount not to exceed $68,108.90. (Fund: Facilities)

G. Take all appropriate action on Purchasing Cooperation Interlocal Agreement between Fort Bend County and Waller County.

H. Take all appropriate action on Addendum to Pier Systems, Inc. Customer Agreement between Fort Bend County and Witt O'Brien's, LLC., pursuant to RFP 06-062, to terminate services effective March 31, 2017, with no additional funds.

I. Take all appropriate action on Seventh Amendment to Agreement between Fort Bend County and Innovative Interfaces Inc., dba Polaris Library Systems for maintenance renewal and six additional licenses utilizing Interlocal Agreement between Fort Bend County and The City of De Soto, in an amount not to exceed $111,444.53. (Fund: Library)

J. Take all appropriate action on Amendment to Agreement between Fort Bend County and Crain Group, LLC in the amount of $7,084.29 for additional services regarding the design/build of the Jones Creek Ranch Administration Building, pursuant to SOQ 16-092, for a total contract amount not to exceed $484,084.29. (Fund: Capital Improvement Project)

K. Take all appropriate action on Second Amendment to Agreement between Fort Bend County and Crain Group, LLC in the amount of $7,700 for additional services regarding the design/build of Jones Creek Ranch Administration Building, pursuant to SOQ 16-092, for a total contract amount not to exceed $491,784.29. (Fund: Capital Improvement Project)

L. Take all appropriate action on Agreement for Construction of Fifth Street Community Center Gymnasium between Fort Bend County and Frost Construction Company, Inc. pursuant to RFP 17-024, in an amount not to exceed $1,388,350. (Fund: Facilities Bond, Proposition 1)

M. Take all appropriate action on Agreement between Fort Bend County and Frost Construction Company, Inc. in an amount not to exceed $1,599,110 for construction of the Pinnacle Aquatic Fitness Center, pursuant to RFP 17-025. (Fund: County Wide Parks Bond, Proposition 1 and Aquatic Center at Pinnacle)

N. Take all appropriate action on Agreement between Fort Bend County and Maintenance Solutions, Inc. for the installation of urethane concrete in the Fort Bend County jail kitchen area in an amount not to exceed $258,197.75, pursuant to Choice Partners Purchasing Cooperative Contract 15/009CG-12. (Fund: Facilities Capital Improvement Project)

O. Take all appropriate action to consider granting an exemption to the competitive bid process as authorized by Texas Local Government Code Section 262.024 (a)(7) for the purchase of an item available from only one source: Collection HQ Subscription service from Bridgeall Libraries Limited in an amount not to exceed $31,824 per year for a total three year cost of $95,472. (Fund: Library)

P. Take all appropriate action on Third Addendum to Software Maintenance Agreement between Fort Bend County and Zoll Data Systems Inc., a sole source provider as authorized by Section 262.024 (a)(7) Texas Local Government Code, in an amount not to exceed $33,595 for FY 2017 maintenance of Rescuenet Software. (Fund: Emergency Medical Service)

Q. Take all appropriate action on Agreement for Access Control Doors between Fort Bend County and Digital Air Control, in an amount not to exceed $11,480 utilizing Choice Partners Purchasing Cooperative Contract 15/037JN-02. (Fund: Library)

R. Take all appropriate action on request for purchase and installation of upgraded equipment, licenses, and maintenance from NWN Corporation for an amount not to exceed $81,880.26 utilizing the State of Texas Department of Information Resources Contracts DIR-TSO-2542 and DIR-TSO-2634, (Fund: Library)

S. Take all appropriate action on Amendment No. 4 to Software and Services Agreement between Fort Bend County and Tyler Technologies, Inc. in an amount not to exceed $51,450 for eCitation and Mobile Solution systems effective through September 30, 2017. (Fund: Sheriff's Office)

T. Take all appropriate action on Amendment to Agreement between Fort Bend County and QC Laboratories, Inc., pursuant to SOQ 14-025, to increase the scope of professional engineering services by $14,900 for a total contract amount not to exceed $54,800 regarding Katy Gaston, Mobility Bond Project No. 733, Precinct 3. (Fund: 2007 Mobility Bonds)

U. Take all appropriate action on Change Order 2 to the Agreement between Fort Bend County and Allgood Construction Co. to extend the contract time until April 9, 2017, pursuant to Bid 16-089, the construction of Katy-Gaston, Mobility Bond Project No. 733a, Precinct 3. (Fund: 2007 Mobility Bonds)

§ 551.071. Consultation With Attorney. Commissioners Court will meet in Closed Session to seek the advice of its attorney about pending or contemplated litigation; a settlement offer; or on a matter in which the duty of the attorney to Commissioners Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551.
